The EU General Court has annulled the September 2024 listing of former Ukrainian MP, Vyacheslav Aleksandrovich Boguslayev on the EU’s Russia sanctions list – Case T-604/24. He remains subject to EU sanctions because of maintaining acts re-listing him in March 2025 until September 2025 (Council Decision 2025/528).
This is Mr Boguslayev’s 2nd successful de-listing application, following the annulment of a separate re-listing decision in June 2025. Mr Boguslayev was originally listed by the EU in 2023. The September 2024 listing (Council Decision 2024/847) stated he had been sanctioned for supporting actions that threatened Ukraine’s territorial integrity, sovereignty, and independence. A former MP from a pro-Russian party, Mr Boguslayev was also said to have supplied engines to the Russian military for use in its war against Ukraine.
Mr Boguslayev challenged his listing, arguing that the Council relied on outdated evidence; he had not held political office since 2019 and had no links with his former company, Motor Sich, since November 2022 & had been in prison since October 2022, making it impossible for him to have supplied military equipment to Russia.
The Court found the Council had made errors in re-listing Mr Boguslayev:
- Boguslayev’s circumstances had fundamentally changed. Mr Boguslayev had been arrested and placed in pre-trial detention from October 2022 and was dismissed from Motor Sich a month later, which was subsequently nationalised by Ukraine. The Council did not adequately consider these developments and did not provide sufficient reasons why Mr Boguslayev should remain listed.
- Council Decision 2025/528 re-listing Mr Boguslayev until 15 September 2025 should be maintained to preserve legal certainty.
- Mr Boguslaev’s claim for compensation was dismissed as he could not show he suffered actual and certain damage.
